The Department published its Regulatory Agenda on page 343 of Issue 2 in Volume 33 of the Illinois Register on January 9, 2009.


  • Community Care Program
    [Joint Committee on Administrative Rules: Administrative Code – Title 89: Social Services, Chapter II: Illinois Department on Aging; Part 240: Community Care Program]*

    NOTICE – Proposed amendments have been filed with the Secretary of State Index Department to add emergency home response as a core service under the Community Care Program as authorized by Public Act 95-565, which will affect Sections 240.120, 240.160, 240.235 (new), 240.1399, 240.1505, 240.1541 (new), 240.1542 (new), 240.1650, 240.1955 (new) in Part 240 of Title 89 of the Illinois Administrative Code. The notice will appear in the Illinois Register on Page 5948 of Issue 17 (PDF) in Volume 33 on April 24, 2009.

    Documents (see PDFs below) have been filed with the Joint Committee on Administrative Rules to start the Second Notice Period for this rulemaking project affecting the Community Care Program. The Second Notice Period will run for approximately 45 days from the date of filing on September 17, 2009. This matter will be reviewed at an upcoming monthly meeting held by the Joint Committee.
    NOTICE – Amendments have been adopted for Sections 240.1970 (new), 240.2020, 240.2023 (new), 240.2030, 240.2040, and 240.2050 of the rules regarding the Community Care Program Advisory Committee in Part 240 of Title 89 of the Illinois Administrative Code, effective December 12, 2008. The notice of adoption for this rulemaking project will be published in the Illinois Register on page 19912 of Issue 52 (PDF) in Volume 32 on December 26, 2008. Updates have already been added in the electronic version of the Illinois Administrative Code at www.ilga.gov.

    NOTICE – An amendment has been adopted in Section 240.1800 of the rule regarding the Community Care Program Advisory Committee in Part 240 of Title 89 of the Illinois Administrative Code, effective May 5, 2008. The notice of adoption for this rulemaking project will be published in the Illinois Register on page 7588 of Issue 20 (PDF) in Volume 32 on May 16, 2008. Updates have already been added in the electronic version of the Illinois Administrative Code at www.ilga.gov.

    NOTICE – Amendments have been adopted for Sections 240.210, 240.730, 240.1505 (new), 240.1510, 240.1520, 240.1525 (new), 240.1530, 240.1535, 240.1550, 240.1555, 240.1560, 240.1600, 240.1605, 240.1607 (new), 240.1615 (new), 240.1620 (repealed), 240.1625 (repealed), 240.1630 (repealed), 240.1635 (repealed), 240.1640 (repealed), 240.1645 and 240.1665 of the rules regarding the Community Care Program. These rules implement various service enhancements for older adults and opens procurement opportunities to all willing and qualified procurement service providers. The notice of adoption for this rulemaking project will be published in the Illinois Register Issue 14 in Volume 33 on April 3, 2009. Updates have already been added in the electronic version of the Illinois Administrative Code at www.ilga.gov.


  • NOTICE – Amendments have been adopted for Sections 240.865, 240.920, and 240.950 of the rules regarding the Community Care Program in Part 240 of Title 89 of the Illinois Administrative Code, effective November 10, 2008. The Notice of Adopted Amendments for this rulemaking project will appear in the Illinois Register on page 17929 of Issue 47 (PDF) in Volume 32 on November 21, 2008. Updates have already been added in the electronic version of the Illinois Administrative Code at www.ilga.gov.

    NOTE: Interested persons may submit written comments on the above proposed rulemaking projects within 45 days after the date of publication of the notices.

      NOTICE – New rules have been adopted to formally establish an Americans with Disabilities Act and Civil Rights Program Grievance Procedure for the Illinois Department on Aging on November 5, 2007. This rulemaking project added a Section 1725 to the Discrimination Procedures in Title 4 of the Illinois Administrative Code. The Notice of Adopted Rules appeared in the Illinois Register on page 11596 of Issue 30 (PDF) in Volume 32 on July 25, 2008.
