NOTICE Proposed rulemaking has been filed with the Secretary of State Index Department to establish an Americans with Disabilities Act and Civil Rights Program Grievance Procedure for the Illinois Department on Aging on November 5, 2007. This rulemaking will add a new Section 1725 to the Discrimination Procedures in Title 4 of the Illinois Administrative Code. It appeared in the Illinois Register on page 15127 of Issue 46 (PDF) in Volume 31 on November 16, 2007. NOTE: Interested persons may submit written comments within 45 days after the date of publication of the notice. - Community Care Program
[Joint Committee on Administrative Rules: Administrative Code Title 89: Social Services, Chapter II: Illinois Department on Aging; Part 240: Community Care Program]*
NOTICE Emergency amendments have been filed that affect Sections 240.1970, 240.2020, 240.2023, 240.2030, 240.2040, and 240.2050
of the rules governing the Community Care Program in Title 89 of the Illinois Administrative Code, effective July 1, 2008, for a maximum of 150 days. These amendments are necessary to create the administrative structure for future implementation of new rates for homecare aide services as authorized by Public Act 95-0713. (Note: Although these rates are intended to take effect on July 1, 2008, the Department will not be able to make any payments until the full program appropriation and budget for the Department becomes final for State Fiscal Year 2009.) The text of the emergency amendments (as well as a notice of proposed rulemaking to codify this new language as a permanent part of departmental regulations) is expected to appear in the Illinois Register on July 18, 2008. Once the official citation is available, a link will be added to it at www.ilga.gov.
NOTICE An amendment has been adopted in Section 240.1800 of the rule regarding the Community Care Program Advisory Committee in Part 240 of Title 89 of the Illinois Administrative Code, effective May 5, 2008. The notice of adoption for this rulemaking project will be published in the Illinois Register on page 7588 of Issue 20 (PDF) in Volume 32 on May 16, 2008. Updates have already been added in the electronic version of the Illinois Administrative Code at www.ilga.gov.
NOTICE Proposed amendments have been filed with the Secretary of State Index Department to implement various enhancements for the Community Care Program as required by Public Act 95-298 and Public Act 95-565, which will affect Sections 240.210, 240.728, 240.729, 240.730, 240.1505, 240.1510, 240.1520, 240.1525, 240.1530, 240.1535, 240.1550, 240.1555, 240.1560, 240.1600, 240.1605, 240.1615, 240.1620, 240.1625, 240.1630, 240.1635, 240.1640, 240.1645, 240.865, 240.920, and 240.950 in Part 240 of Title 89 of the Illinois Administrative Code. It will appear in the Illinois Register on Page 7445 of
Issue 20 in Volume 32 on May 16, 2008.
NOTICE Proposed amendments have been filed with the Secretary of State Index Department to update Sections 240.865, 240.920, and 240.950, which relate to the Community Care Program in Part 240 of Title 89 of the Illinois Administrative Code. This rulemaking project implements Public Act 95-565 (effective June 1, 2008) (clarifying eligibility requirement for new applicants seeking in-home and community-based services to make a good faith effort standard to enroll in the Medical Programs under Article V of the Illinois Public Aid Code). It will appear in the Illinois Register on page 16599 of Issue 51 (PDF) in Volume 31 on December 21, 2007.
